Odometer Discrepancies

Odometer Requirements - Non-Exempt Vehicles Requiring a Title

At the time of sale or transfer of ownership of a vehicle, the seller(s)/transferor(s), are required to

  • Enter the vehicle's current odometer reading, as of the date of sale or transfer, on an acceptable secure transfer document (i.e. Title, Dealer Reassignment, or Secure Power of Attorney, when this power of attorney is allowed);
  • Check the applicable box when the vehicle's odometer does not reflect the total actual miles the vehicle has traveled; and,
  • Print and sign his and/or her own full legal name(s). If jointly owned, both owners must print and sign their full legal names. If the seller or transferor is a company, the printed name of the company must be entered as well as the agent's printed name and signature. The person entering the information for a company, should enter their position with the company after their signature (i.e. Owner, Manager, Title Clerk, etc.).
  • Enter the purchaser(s)'/transferee(s)', full legal name(s), current address and the date of sale or transfer on the transfer document. A natural person's full legal name would be his or her complete name as shown on his or her valid Georgia driver's license or Georgia identification card. Important: The odometer readings throughout the chain of ownership of a vehicle should increase in number. Only in rare occasions should the reading stay the same (i.e. Classic vehicle never driven put towed to and from auto shows, etc.).

For exempt vehicles, enter the word "exempt" in any space provided for an odometer reading.

An odometer reading may continue being shown even after the vehicle's year model makes it exempt as long as the readings throughout the chain of ownership either remains the same or increases in number. Once a vehicle is declared "exempt" (when allowed), a title can never be issued reflecting an odometer reading.

What to Do - Odometer Reading Recorded Incorrectly

If the seller(s)/transferor(s) enter an incorrect odometer reading on a transfer document, they should complete the top portion of a T-107 Odometer Discrepancy Affidavit including the correct reading and the reason for entering an incorrect odometer reading (i.e. I guessed at the reading; I own two vehicles and I recorded the odometer reading for the wrong vehicle; I made a mistake when entering the reading; etc.).

The purchaser(s) should then complete the bottom portion of the T-107 Odometer Discrepancy Affidavit acknowledging the error. If jointly purchased, both owners must print and sign their name. If the discrepancy occurred several owners back, more than one T-107 affidavit may be required starting at the point where the reading was entered incorrectly up through the current owner(s) to ensure everyone in the chain of ownership is aware of the discrepancy.

If the title has not been applied for yet, then the completed T-107 Odometer Discrepancy Affidavit(s) should accompany the title application (reflecting correct information), supporting documents and applicable title fees when being submitted for transfer.

When the title was issued reflecting an incorrect odometer reading, a new title with correct information may be issued free if the error was a result of a keying error and the Department of Revenue, Motor Vehicle Division's microfilm title records support the correct information. In this case, the title should be returned to the Department of Revenue, Motor Vehicle Division with a completed MV-18 Affidavit of Correction. There is no charge for this service when the state-maintained microfilm records (including the title application) reflect the correct odometer reading.

If the title was issued reflecting an incorrect odometer reading because the reading was recorded in error on only the title application (not on the transfer documents - i.e. Title already in applicant's name(s) submitted to obtain a title showing a security interest holder), the title may be returned with a new MV-1 title application, typed or printed electronically or legibly by-hand in blue or black ink in the owner(s)' full legal name(s) reflecting the correct reading; a completed T-107A Odometer Discrepancy on Title Application Affidavit and the title fee of $18 (cash, check or money order payable to the office processing the transaction, Office of the Tax Commissioner or the Department of Revenue. Please do not remit cash through the mail.

Apply for a new title by submitting the completed T-107 Odometer Discrepancy Affidavits by mail or in-person to your county Tax Commissioner's office or Department of Revenue's Motor Vehicle Division (MVD) with the following:

  • A completed MV-1 title application - typed or printed in blue or black ink electronically or legibly by-hand, except signature(s), in the owner(s)' full legal name(s) reflecting the correct odometer reading and signed. A natural person's full legal name would be his or her complete name as it appears on his or her valid Georgia driver's license or Georgia identification card. For natural persons, enter each owner's valid Georgia driver's license number or Georgia identification card number in the spaces provided. If all owner(s) go in-person to their county Tax Commissioner's office with their valid Georgia driver's license or Georgia identification card, the required documents and fees, this application can be completed and printed for your signature(s) and processing.
  • Original valid title;
  • Any other required supporting documents;
  • Cash, check or money order for the total fees due payable to the office processing the transaction (Office of the Tax Commissioner or Department of Revenue). Please do not submit cash through the mail;
  • $18.00 title fee;
  • $10.00 title penalty is due when the owner(s) fail to apply for a Georgia title in their name(s) within ninety-days (90) of the vehicle's purchase or transfer date. This fee is not due if the vehicle is currently titled in the applicant(s)' name(s);
  • $10.00 additional title penalty is due if the applicant(s) previously applied for a Georgia title in his and/or her name(s) for this vehicle and their application was returned requesting additional action before title issuance and compliance has not been made within sixty-days (60) of the accompanying letter's date.
  • $10.00 special handling fee if the title application is processed through the In-person Customer Service Operations of State Motor Vehicle Divison of the Department of Revenue.
