What is needed to obtain a Georgia Title for a
vehicle after court action?

A completed
MVD MV-1 title application - Except for the signature(s), type,
electronically complete and print or print legibly by-hand in
blue or black ink in your full legal name(s). If jointly owned,
each
owner's full legal name, valid driver's license number and signature is required.
An individual's full
legal name would be his/her
complete name as it appears on
his/her valid driver's license.
For individual owners, enter each owner's valid
driver's license number
in the spaces provided. This application can be used to apply
for both a tag and title for your vehicle at your County Tag Office.
Click

on this page to electronically complete and print it for signing
and submission. If all owners go in person to their County Tag Office with their valid driver's license, the required documents, and
applicable fees and taxes, this application can be completed
and printed electronically for your signature(s) and processing.

Original valid title and any other available
ownership documents;

A certified copy of the Court Order. A certified
copy of any court document requires the Clerk of the Court's
signature and his or her seal or stamp.

A certified copy of the Levying Order if
the vehicle's description (year model, make of vehicle and the
vehicle's identification number) is not included in the Court
Order;

A
completed bill of sale (form T-7) conveying ownership
to you, the purchaser(s) - Except for the signature, type, electronically
complete and print or legibly hand print in blue or black ink
in the purchaser(s)' full legal name(s) and signed by the person
authorized by the Court to sell the vehicle.

A
completed Form T-22B, Certification of Inspection,
is required when the title, issued for the vehicle, is
not
submitted. Except for the signature, this form must be typed,
electronically completed and printed or legibly hand printed,
in blue or black ink. A Georgia law enforcement officer or a
Georgia County Tag Agent or his/her
designated employee
must
complete and sign this form
after making a visual inspection
of your vehicle's serial plate. All documents submitted for
title issuance must reflect your vehicle's correct and complete
vehicle identification number (VIN) as shown on the vehicle's
serial plate.

For all vehicles sold pursuant to court
action, a public sale is required unless otherwise instructed
in the Court Order. See the definition of a public sale below.
If you were the highest bidder of this vehicle at the public
sale and you are also the person authorized by the Court to
sell the vehicle, you must submit an affidavit to this effect.

Submit a copy of the newspaper advertisement
or the advertisement posted at the courthouse where other legal
notices are posted including the vehicle's description (Year
model, make of vehicle and serial number) and announcing the
sale of the vehicle when you are applying for a title in your
name and you are also the person authorized by the Court to
sell the vehicle;

The vehicle's license plate, if left on the
vehicle must be submitted.

$18.00 title fee.

$10.00 title penalty will be assessed if
the purchase date shown on the transfer document has been altered.

$10.00 penalty is due if you, the purchaser(s),
fail to apply for a Georgia title in your name(s), for vehicles
requiring a Georgia title, within ninety-days (90) of the vehicle's
purchase date
- Pay all fees due with cash, check or money order payable
to the office processing your application, Department of
Revenue or the Office of the Tax Commissioner.
Please do not send cash through the mail!
Some counties accept credit cards.
A Georgia title will not be
issued for a 1985 or older year model vehicle or for a vehicle that
does not require a Georgia
title (i.e. Airplanes, boats, pole trailers, mopeds, etc.) based
on a Court Order. Click

Where to Apply
For vehicles requiring a Georgia title, you should
apply for your Georgia title as soon as possible after you purchase
the vehicle at the
Tag Office in the county in Georgia where you
reside or with Motor
Vehicle Division.
If you are also applying for a license plate for
the vehicle, you must apply at your County
Tag Office. You have thirty-days (30) from the
date of sale to register and obtain a Georgia license plate for
your vehicle or to transfer a valid license plate from a vehicle
you no longer own to this vehicle to avoid fines if stopped by law
enforcement. For vehicles requiring a Georgia title, you will be
unable to register and obtain a Georgia license plate for your vehicle
or a tag transfer without a Georgia title already issued in your
name or without applying for a Georgia title at the time of registration.

"Public sale" means a sale:
1. Held at a place reasonably available to persons
who might desire to attend and submit bids; and
2. At which those attending shall be given the
opportunity to bid on a competitive basis; and
3. At which the sale, if made, shall be made to
the highest bidder; and
4. Except as otherwise provided by law for advertising
or dispensing with the advertising of public sales, of which notice
is given by advertisement once a week for two weeks in the newspaper
in which the sheriff's advertisements are published in the county
where the sale is to be held, and which notice shall state the day
and hour, between 10:00 a.m. and 4:00 p.m., and the place of sale
and shall briefly identify the goods to be sold.
