What is needed to record a lien or security interest against a motor vehicle?

For a vehicle that requires a Georgia certificate of title, a lien or security interest is recorded on the certificate of title. Click here for a list of vehicles that do and do not require a Georgia title.

To apply for a Georgia title showing a lien or security interest, submit the following to the applicable county tag office in this state or to this department's Motor Vehicle Division. Click here for additional information regarding where to apply for a Georgia title.

  • An original, completed and signed MVD tag and/or title application, Form MV-1 - typed, electronically completed and printed or hand printed in the vehicle owner's full legal name showing his/her valid Georgia driver's license or Georgia identification card number and signature. If jointly owned, each owner's full legal name, valid Georgia driver's license or Georgia identification card number and signature are required. An individual's full legal name is his/her complete name as it appears on his/her valid Georgia driver's license or Georgia identification card.

    If the owner is not required to obtain a Georgia driver's license as provided by §40-5-21 of Georgia law, record the owner's out-of-state or country driver's license number and the name of the issuing state or country in the spaces provided for this information on the form MV-1. A link is provided from this department's website, www.dor.ga.gov, to the Georgia Code.

    Enter each lien or security interest holder's full legal name, address, and MVD assigned permanent customer number in the order each lien or security interest was recorded on the form MV-1. Contact your financial institution for their MVD assigned permanent customer number and their address where titles are to be mailed.

  • The original valid title or manufacturer's certificate of origin issued in the vehicle owner's name or properly assigned to him/her, using his/her full legal name. The owner's complete name on the application, supporting transfer document and identification must match!
  • Pay all fees and taxes due with cash (in-person only), check or money order made payable to the office processing the application, Office of the Tax Commissioner or the Department of Revenue. Please do not remit cash through the mail! Counties require personal checks to be imprinted with a local bank's address. Out-of-state checks are not accepted. Contact the county tag office for additional methods of payment.
    • $18 title fee
    • $10 penalty fee must be included in your payment if the owner, when required, fails to apply for a title in his/her name for the vehicle within 90 days of the purchase or ownership transfer date.
      This title penalty fee is not due if the vehicle is already titled in the applicant's name. Effective July 1, 2008, if a Georgia title is not applied for, when required, within 30 days of the purchase or ownership transfer date, a $10 title penalty fee must be included in your payment.

Most title applications processed by the county tag offices in this state result in the printing and mailing of the titles by this department's Motor Vehicle Division within 3 business days of the county's entry and approval at no additional charge !

When is Security Interest Perfected?

A security interest will be perfected as of the contract's creation date if the title application or T-53D Notice of Security Interest form and the required filing fee are filed within 20 days of the contract's creation date. Otherwise, it will not be perfected until the date the Motor Vehicle Division or the county tag office receives the title application or T-53D Notice of Security Interest showing the security interest holder information, the required supporting documents (when applicable - see above), and the required fees.

Filing of T-53D Notice of Security Interest

When there is going to be a delay in applying for a Georgia title showing a security interest holder, a T-53D Notice of Security Interest may be completed and submitted with an $18.00 filing fee to either the Motor Vehicle Division or the tag office in the county in Georgia where the: vehicle owner resides; the seller is located; the sale takes place or the vehicle is delivered. This form must be typed, electronically completed and printed or hand printed in blue or black ink and signed. Click on any form name or number on this page to electronically complete it for printing, signing and submission by mail or in-person to the county tag office or the Motor Vehicle Division by mail or in-person.

If the T-53 Notice of Security Interest form (properly completed) and the $18.00 filing fee are received within 20 days of the contract's creation date, the security interest will be perfected as of the contract's creation date. To file a T-53D Notice of Security Interest , submit the following to either the Motor Vehicle Division or the applicable county tag office in this state.

  • An original, completed T-53D Notice of Security Interest form - typed, electronically completed and printed or hand printed in blue or black ink in the vehicle owner's full legal name. An individual owner's full legal name is his/her complete name as it appears on his/her valid Georgia driver's license or Georgia identification card.

  • $18 title fee. Pay all fees due with cash (in-person only), check or money order made payable to the agency processing the transaction, the Department of Revenue or the Office of the Tax Commissioner. Please do not remit cash through the mail!

Vehicles Not Requiring a Georgia Title

For vehicles not eligible for a Georgia title, a lien or security interest is recorded in this state against a motor vehicle with the Clerk of the Superior Court's office in the county in Georgia where the vehicle owner resides under the provisions of the Universal Commercial Code.
