Joint Ownership and Joint Tenants With Survivorship
When applying for a Georgia Certificate of Title and/or license
plate (tag) showing joint ownership, you must use the word "and"
instead of "or". This requires all owners to sign the
title application and the assignment of title when the vehicle's
ownership is transferred.
You may choose to have your Georgia Certificate of Title issued
reflecting the following disclosure or brand: "Joint Tenants
With Survivorship".
To request that a Georgia Title be issued with this disclosure
or brand either tell the person processing your transaction (if
you go in person) or enter "Joint Tenants With Survivorship"
below your names on your MV-1 tag and/or title application. It is
recommended that you use a marker to highlight this disclosure on
your application. The application should be submitted with the original
valid title or manufacturer's certificate of origin either issued
in the applicants' names or properly assigned to to the applicants
using their full legal name(s) and the applicable
title fees. A natural person's full legal name would be his
or her complete name as shown on his or her valid Georgia driver's
license or state-issued identification card. Click
here to read this Department's policy regarding identification
and applications for Georgia tags and/or titles. For natural persons,
enter each owner's valid Georgia driver's license number or Georgia
identification card in the spaces provided for this information
on their MV-1 application.
By having your title issued with "Joint Tenants With Survivorship"
and one of the owners dies, the surviving owner may transfer the
title to another party by only completing the assignment of title
and attaching a copy of the deceased's death certificate. The new
owner should then apply for a title in his or her name through his
or her county Tax Commissioner's office. This brand or legend does
not transfer from one title to the next. If the vehicle is purchased
jointly, the new owner(s) may wish to have this disclosure or brand
placed on their title when issued. To do so, they should comply
with the above instructions.
